Common Law Marriage
California has abolished the concept of common law marriage. A valid marriage cannot be created in California solely by the parties' consent or mere cohabitation. California will recognize a common law marriage that was entered into in another state if the common law marriage was legal in that state. We have noticed in our practice that many of our clients mistakenly believe that extended cohabitation with a boyfriend or girlfriend results in a common law marriage – this is simply not the case in California.
